Terms of Service

These Terms of Service ("Terms") govern your use of this website and your booking of boat rentals and captained charters from OKGN Boat Rentals ("we", "us", or "our") on Okanagan Lake in Kelowna, BC. By using our website or booking with us, you agree to these Terms. If you do not agree, please do not use our services.
Our Services
We offer captained boat charters on Okanagan Lake. Every rental includes a commercially licensed, OKGN-approved captain who operates the boat. Details such as boats, capacity, pricing, and availability are described on our website and may change without notice.
Bookings and Requests
Fixed time slots may be reserved through online payment where available. Custom time requests are not confirmed until we contact you. In all cases, final departure remains subject to boat availability, payment status, weather, lake conditions, documentation, safety approval, and any required dockside briefing. We may decline, reschedule, or cancel a booking if a boat is unavailable, required information is missing, or conditions are unsafe. You agree to provide accurate and complete information when booking.
Eligibility and Rental Requirements
- You must be at least 19 years of age to make a booking.
- Captain included: every rental includes a commercially licensed, OKGN-approved captain who operates the boat, so no Pleasure Craft Operator Card is required for guests.
- The captain is responsible for safe operation of the boat, and all guests must follow safety rules, capacity limits, and the captain's directions at all times.
Payment
Prices are quoted in CAD and are confirmed at booking. Applicable taxes (GST and PST) and fees may be added where required. Additional charges may apply for damage, excessive cleaning, late return, missing equipment, fuel differences, or extra time, as described below or in your booking confirmation.
- Full payment: Full payment — the whole rental amount — is required at the time of booking to secure your specific boat, date, and time slot. No dates or vessels are held or guaranteed without full payment.
- Accepted payment: Cash and Interac e-Transfer (to info@okgnboatrentals.ca, including your booking name and reservation date) can be arranged by contacting us directly. We also accept all major credit cards (Visa, Mastercard, American Express) through our secure online booking system or over the phone.
- Card security: Card details are not stored on file for automatic follow-up charging.

Cancellations, Weather, and Rescheduling
Because our boats are held exclusively for your scheduled reservation, the following cancellation terms apply to your payment:
- If you cancel more than 2 weeks (14 days) before your scheduled departure date, you receive a full refund of your payment to your original payment method.
- Cancellations made within 2 weeks (14 days) but more than 7 days before the departure date forfeit a $150 booking fee; the remainder of your payment is refunded.
- Cancellations made within 7 days of the departure date forfeit 50% of the total amount paid; the remaining 50% is refunded.
All refunds are processed through Stripe back to your original payment method, and may take a few business days to appear depending on your bank or card issuer.
Weather and safety ("Captain's Call"). Your safety always comes first. The decision to cancel, delay, or cut short a rental due to water or weather conditions rests solely with OKGN staff at the time of departure, based on real-time conditions evaluated live at the dock — not on forecasts. Cancellations for weather are issued only when dangerous conditions such as lightning, high winds, or large white caps are present or imminent; we do not cancel for overcast skies, cooler temperatures, or light drizzle. If we cancel due to unsafe conditions, you may choose a 100% refund of your payment or a $190 rental credit (an extra $40 in value).
Business booking errors. In the rare event that we must cancel or adjust your reservation due to an internal booking, maintenance, or scheduling conflict on our end, you may choose a 100% refund of your payment or a $200 rental credit (an extra $50 in value).
Rental credit terms. Any promotional rental credit ($190 for weather cancellations or $200 for business booking errors) is strictly non-refundable, cannot be converted back into a cash or card refund, and must be used before the end of the following summer operating season or it is forfeited entirely.

Fuel and Refueling
Every vessel is normally dispatched with a full tank of fuel. You are required to refuel the boat yourself at a local marina gas dock before returning, bringing the tank back to full (or to the agreed starting level if it was dispatched less than full), and to present a matching fuel dock receipt at check-in. If the marina pumps are too busy, the OKGN captain on duty may waive the self-refuel requirement; in that case, and any time the boat is returned below its required level without a receipt, refueling is billed at a flat rate of $2.35 per litre based on the dashboard gauge, rounded up to the nearest eighth of a tank. Gauge-based fuel charges must be settled on-site before the rental is closed. Full fueling and dockside safety procedures are provided in our fueling policy.

Conduct and Safety
- The captain's instructions must be followed at all times, on the dock and on the boat, with no exceptions. The captain has full authority over the boat and may refuse boarding or end a trip early if safety is at risk. No refund is owed where a trip ends due to unsafe or unlawful guest behaviour or failure to follow the captain's instructions.
- You must not exceed the boat's rated guest capacity.
- Life jackets and safety equipment must be used as directed.
- Illegal activity is not permitted on board. Guests must not operate the boat or water-sports equipment while impaired.
- Children must be supervised by a responsible adult at all times.
- All guests and operators must follow the safety requirements described on our Safety & Requirements page and any dockside briefing.
Assumption of Risk
Boating and water sports involve inherent risks, including the risk of injury. By booking and participating, you acknowledge and voluntarily accept these risks for yourself and your guests. You may be asked to sign a separate waiver before your trip.
Damage and Responsibility
You are responsible for loss or damage to the boat, equipment, or property caused by you or your guests beyond normal wear, and for any related costs. We are not responsible for personal belongings lost or damaged during a trip.
Limitation of Liability
To the fullest extent permitted by law, OKGN Boat Rentals and its crew are not liable for any indirect, incidental, or consequential damages arising from your use of our website or services. Nothing in these Terms limits liability that cannot be excluded under applicable law.
Intellectual Property
The content on this website, including text, images, logos, and branding, is owned by or licensed to OKGN Boat Rentals and may not be copied or used without permission.
Third-Party Links
Our website may link to third-party sites and services. We are not responsible for their content, products, or practices.
Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada. Any disputes will be handled in the courts of British Columbia.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our website or services after changes take effect means you accept the updated Terms.
